Federal Court Mandates Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in immigration detention.

In her order, the judge pointed out that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.

Conditions of Freedom

The judge, who was overseeing his petition to removal in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
